By accessing or using Powerbuyer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Powerbuyer is an Etsy marketplace scanning and monitoring service that collects and displays Etsy listings in real-time. The Service provides tools for searching, filtering, organizing, and receiving notifications about Etsy marketplace listings.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms or fraudulent, abusive, or illegal activity.
Powerbuyer offers a 10-day free trial for new users, followed by the Pro subscription plan. Details are available on our Pricing page. After the trial period ends, continued access requires an active paid subscription.
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All payments are processed through Stripe, a third-party payment processor.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time from your account dashboard.
We offer a 30-day money-back guarantee for your first payment. After 30 days, payments are non-refundable except as required by law. If you cancel your subscription, you will continue to have access until the end of your current billing period.
We reserve the right to change our subscription prices at any time. Price changes will be communicated to you at least 30 days in advance and will take effect at your next billing cycle.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
We reserve the right to implement rate limiting or other technical measures to prevent abuse of the Service. Excessive or abusive use may result in temporary or permanent suspension of your account.
Powerbuyer aggregates data from Etsy via the official Etsy API. We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. Your interactions with Etsy are governed by Etsy's own terms of service and privacy policies.
Powerbuyer uses Etsy's official API to retrieve marketplace listings. Our use of the Etsy API is subject to the following:
The Service and its original content, features, and functionality are owned by Powerbuyer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
IN NO EVENT SHALL POWERBUYER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Powerbuyer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Powerbuyer regarding the use of the Service and supersede all prior agreements and understandings.
